Pour autant, les entreprises qui vont faire appel \u00e0 ces emplois ne doivent pas oublier les obligations juridiques li\u00e9es \u00e0 ce type de contrat, identiques \u00e0 celles li\u00e9es \u00e0 l&#8217;embauche de tout salari\u00e9.<\/strong><\/em><\/p>\n<h2 align=\"left\">L&rsquo;urssaf, dans cette p\u00e9riode pr\u00e9contractuelle, rappelle les trois points sur lesquels les entreprises doivent \u00eatre vigilantes\u00a0:<\/h2>\n<ol>\n<li>\n<p align=\"left\">Une DPAE (D\u00e9claration pr\u00e9alable \u00e0 l&#8217;embauche) est obligatoirement transmise \u00e0 l\u2019Urssaf comp\u00e9tente avant la date pr\u00e9visible d&#8217;embauche d&rsquo;un salari\u00e9.<\/p>\n<\/li>\n<li>Un contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e doit \u00eatre conclu avec le \u00ab jeune \u00bb .<\/li>\n<li>Les r\u00e8gles g\u00e9n\u00e9rales du code du travail et les dispositions de la convention collective sont applicables \u00e0 un salari\u00e9 embauch\u00e9 dans le cadre de job d&rsquo;\u00e9t\u00e9.<\/li>\n<\/ol>\n<h2 align=\"left\"><b>ZOOM sur ces trois points \u00e0 observer\u00a0:<\/b><\/h2>\n<p align=\"left\">1. <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000024214323&amp;cidTexte=LEGITEXT000006072050\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">L&rsquo;article R1221-4 du code du travail<\/a> impose aux employeurs d&rsquo;adresser une d\u00e9claration pr\u00e9alable \u00e0 l&#8217;embauche d&rsquo;un salari\u00e9 \u00e0 l&rsquo;urssaf comp\u00e9tente huit jours avant la date d&#8217;embauche pr\u00e9vue par le contrat de travail. Cette d\u00e9claration peut \u00eatre effectu\u00e9e sur internet ou envoyer par la poste en recommand\u00e9.<\/p>\n<p align=\"left\">2. Le contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e -CDD- est obligatoirement \u00e9crit et doit pr\u00e9ciser les mentions pr\u00e9vues par l&rsquo;article <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006901206&amp;cidTexte=LEGITEXT000006072050\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">L1242-12 du code du travail\u00a0<\/a>; \u00e0 d\u00e9faut il peut \u00eatre r\u00e9put\u00e9 conclu pour une dur\u00e9e ind\u00e9termin\u00e9e.<\/p>\n<p align=\"left\">3. Concernant les r\u00e8gles conventionnelles et g\u00e9n\u00e9rales du code du travail\u00a0: Il conviendra d&rsquo;\u00eatre attentif \u00e0 la dur\u00e9e maximale et hebdomadaire du temps de travail, au respect des r\u00e9mun\u00e9rations minimales conventionnelles ainsi que des obligations de s\u00e9curit\u00e9 qui incombent \u00e0 l&#8217;employeur.<\/p>\n<p align=\"left\">A ce titre il est important de pr\u00e9ciser que le travail des jeunes est autoris\u00e9 d\u00e8s l&rsquo;\u00e2ge de 16 ans voire de 14 ans sous certaines conditions ( effectuer de petits travaux pendant les vancances scolaires). La dur\u00e9e du travail de ces jeunes est strictement encadr\u00e9e\u00a0et, sauf exeption, le travail de nuit leur est interdit.<\/p>\n<p align=\"left\"><b>NB\u00a0: l&rsquo;indemnit\u00e9 de pr\u00e9carit\u00e9 n&rsquo;est pas due lorsque le contrat est conclu avec un jeune pour une p\u00e9riode comprise dans ses vacances scolaires ou universitaires <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006901221&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20140617&amp;oldAction=rechCodeArticle&amp;fastReqId=1887534417&amp;nbResultRech=1\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">(article L1243-10 du code du travail)<\/a><\/b><\/p>\n<p align=\"left\">Pour finir, l&rsquo;Urssaf rappelle aux entreprises que le d\u00e9faut de d\u00e9claration d\u2019embauche, l\u2019absence de bulletin de paie , la mention d\u2019un nombre d\u2019heures sur le bulletin de salaire inf\u00e9rieur \u00e0 celui r\u00e9ellement accompli, le manquement aux obligations d\u00e9claratives p\u00e9riodiques et\/ou de paiements des cotisations et contributions sociales sont constitutifs du d\u00e9lit de travail dissimul\u00e9.<\/p>\n<p align=\"left\">L&rsquo;Ecole Fran\u00e7aise de Comptabilit\u00e9 propose des formations professionnelles \u00e0 distance, qui s&rsquo;adaptent au rythme de chacun.
